BJP MP’s Attack on Chief Justice Sparks National Outrage and Legal Backlash

New Delhi: BJP MP Nishikant Dubey has stirred a political and legal storm with his explosive remarks targeting Chief Justice of India, Sanjiv Khanna. In a statement that has drawn sharp criticism across the board, Dubey blamed the Chief Justice for all the problems plaguing the country, including what he described as a "civil war-like' atmosphere. He further asserted that if the Supreme Court continues to make laws, then the Parliament should be shut down.

Dubey accused the judiciary of exceeding its constitutional boundaries and alleged that the Supreme Court, along with the Chief Justice, is responsible for escalating communal tensions across the nation. "If everyone starts approaching the Supreme Court for every issue, then there is no relevance for the Parliament," the MP said, adding that the judiciary is undermining the authority of the legislature.

These comments came in response to queries about the recent communal violence in Murshidabad, where Dubey pointed fingers at Chief Justice Khanna, holding him directly responsible for the unrest. The remarks triggered widespread condemnation, with BJP national president J P Nadda swiftly distancing the party from Dubey’s statement, calling it a personal opinion. However, the party has not yet taken any disciplinary action against the MP.

Dubey, who represents Godda constituency in Jharkhand, is not new to controversy. In recent months, several BJP leaders, including Vice President Jagdeep Dhankhar and Dinesh Sharma, have publicly criticised the judiciary over key rulings—especially those concerning the Waqf Act and delays by state governors in assenting to bills. The judiciary's active stance on these matters has increasingly irked the ruling establishment.

The controversy deepened after Dubey posted his statements on social media platform 'X' (formerly Twitter), intensifying public scrutiny. Supreme Court advocate Anas Tanveer has since written to the Attorney General demanding contempt of court proceedings against the MP, calling his remarks deeply insulting and provocative. Several opposition parties have echoed this call, urging the Supreme Court to take suo motu cognizance of the matter.

The timing of Dubey’s statement is seen as a direct reaction to a recent Supreme Court order that set a time frame for the President to act on bills cleared by state legislatures—an order that has drawn criticism from the BJP-led central government. As the confrontation between the judiciary and the executive intensifies, Dubey’s comments have added fuel to the fire, sparking a fresh debate on the limits of political speech and the sanctity of judicial institutions.

AILU Calls for Nationwide Protest Against Threats to Judiciary by BJP MP
New Delhi: In a strong and unequivocal statement, the All India Lawyers' Union (AILU) has called for a nationwide protest against what it describes as a direct assault on the independence of the judiciary by Vice President Jagdeep Dhankhar and BJP MP Nishikant Dubey.

AILU President Bikas Ranjan Bhattacharya and General Secretary P V Surendranath, in a joint statement, condemned the recent utterances of the Vice President as a blatant interference in the functioning of the judiciary. “These are not stray remarks. This is a part of a calculated strategy by the Sangh Parivar regime to silence the judiciary and bend it to its authoritarian will,” the statement said.

The Vice President, holding a constitutional position that demands restraint and respect for institutions, has been repeatedly making statements undermining the judiciary. AILU asserted that these remarks amount to a threat and clear violation of the principle of separation of powers.Adding to the provocation, BJP MP Nishikant Dubey made controversial statements accusing the Chief Justice of India and the judiciary of being responsible for communal riots in the country. The MP’s remarks came in the context of the Supreme Court's intervention in matters related to the Waqf (Amendment) Act. He further claimed that the judiciary has no authority to strike down laws passed by Parliament — a statement that flies in the face of constitutional jurisprudence.

“These are not mere criticisms. These are contemptuous, defamatory, and dangerously irresponsible remarks aimed at delegitimising the judiciary,” AILU leaders said, warning that the BJP and Sangh Parivar's broader agenda of establishing a Hindutva Rashtra requires dismantling constitutional checks like an independent judiciary.

The lawyers’ body has called on all its units across the country, along with the wider legal fraternity, to organise peaceful protests. “It is our bounden duty to defend the Constitution and democracy. The independence of the judiciary is sacrosanct — a cornerstone of our democratic structure,” the statement affirmed.The AILU's call comes at a time when constitutional values are facing growing threats from the highest echelons of power. The organisation has urged all democratic forces to join hands in resisting this erosion and to raise their voices in defence of the judiciary and the Constitution.
