Kerala High Court Quashes Case Against ADGP Ajithkumar, Strikes Down Remarks on CM

Kochi: The Kerala High Court has quashed the case against ADGP M R Ajithkumar related to allegations of illegal asset accumulation. The court set aside the Vigilance Court order that had directed further action against the officer. The single bench issued its judgment while considering Ajithkumar’s petition challenging the Vigilance Court’s decision to reject the Vigilance report that had found no evidence against him.


The High Court noted that the Vigilance Court had acted in violation of proper legal procedures while passing its earlier order.


The court also cancelled the remarks made by the Vigilance Court against the Chief Minister during the same proceedings. The Vigilance Court had questioned the Chief Minister’s approval of the Vigilance report and had implied that “invisible forces” were influencing the case in favour of the ADGP. The state government challenged these remarks before the High Court, which struck them down. Justice Badharudeen observed that the comments were inappropriate.


The High Court clarified that the complainant may pursue the case further only after obtaining prosecution sanction.


The Vigilance report submitted to the Chief Minister had stated that the allegations against Ajithkumar were baseless, and the Chief Minister accepted the report. A petitioner later approached the Vigilance Court, which rejected the report, prompting Ajithkumar to move the High Court.
